NUEVAS OPORTUNIDADES EN LOS ESTADOS UNIDOS


VISA

Visas de negocios (B-1)

Generalmente, los viajeros que buscan admisión a los Estados Unidos para llevar a cabo asuntos de negocios requieren una visa válida B-1, a menos que sean elegibles para viajar sin visa a través del Programa de Exención de Visas o que sean ciudadanos de un país que tenga un acuerdo con los Estados Unidos que les permita viajar a los Estados Unidos sin una visa B-1.
La definición de "negocios" en este caso es limitada, y generalmente no permite un empleo remunerado o una actividad productiva, tal como administrar un negocio o realizar trabajos de consultoría.  Específicamente, según las leyes aplicables de los Estados Unidos, el término "negocio" se limita a la negociación de contratos, consulta con socios de negocios, litigios y participación en congresos científicos, educativos, convenciones profesionales o de negocios, conferencias o seminarios y otras actividades legítimas de carácter comercial o profesional. No incluye tener un empleo u ofrecer servicios por contratación en los Estados Unidos.
Si usted no es elegible para viajar sin visa, ni es ciudadano de un país que ha sido exonerado de los requerimientos de la visa B-1, usted deberá solicitar una visa antes de viajar.

Proceso de solicitud de visa
Por favor, revise los CUATRO PASOS siguientes antes de iniciar el proceso de solicitud de su visa.
Paso 4: Si alguna vez usted fue arrestado o hallado culpable de algún delito, tiene una inelegibilidad médica, le negaron el ingreso a los Estados Unidos o fue deportado de ese país, deberá presentar  documentos relacionados con esa situación en sustento de su solicitud.
Se recomienda que los solicitantes empiecen el proceso de solicitud de visa con bastante anticipación antes de la fecha programada de viaje.  No se ofrece ninguna garantía sobre la emisión de visas antes de la entrevista.  Por lo tanto, se recomienda no concretar planes de viaje ni comprar pasajes que no sean reembolsables hasta que la visa haya sido emitida y el solicitante haya recibido su pasaporte a través de DHL.

Gerawan farm workers face a David vs. Goliath battle.Gerawan Farming Inc. is one of the world's largest fruit growers with about 6,000 workers. Workers voted for the United Farm Workers and have tried negotiating with the company without success. Now, thanks to a law that supporters like you helped us pass, the California Agricultural Labor Relations Board has assigned a neutral mediator to resolve issues of disagreement so workers can have what they voted for: a union contract. You can help them by signing their petition today and/or by making a donation to help us fight the expensive legal battle Gerawan has forced us to assume.

Gerawan has engaged three separate law firms and an army of lawyers to keep its workers from their goal. Our legal team has been hard at work, winning decision after decision against Gerawan's high-priced lawyers.

A basic principle of state and national labor law makes it patently illegal for a company to play ANY role whatsoever in a bid to decertify, or get rid, of its workers' union. Only workers can make that decision. But on Wednesday, the state Agricultural Labor Relations Board dismissed a petition to decertify the UFW at Gerawan. A blistering 12-page dismissal notice documented Gerawan's illegal company circulation and support for the drive to get rid of the union and found widespread forgeries of signatures on the decertification petition. 

This came after a Superior Court judge issued an injunction against Gerawan, ordering it to refrain from such illegal conduct. And even with Gerawan's unlawful practices, there were not enough valid signatures to call for an election...therefore showing that the UFW continues to enjoy overwhelming  support of the workers.

Here are highlights from the 12-page ALRB decision:

  • The ALRB stated, "Our investigation has revealed that there has been significant unlawful assistance by [Gerawan] in the circulation of the petition, by gathering signatures for the petition and by providing other material assistance to employees in the decertification process.
     
  • The ALRB ruling recognized, "When an employer has unlawfully instigated or assisted workers in a decertification campaign, it has interfered with its employees' free exercise of their rights... "
     
  • "Furthermore, an attorney who represents two of Gerawan's farm labor contractors [represented the petitioner]. "This was found to be unlawful by the ALRB: "In sum, our investigation has found that Gerawan has directly assisted the Petitioner and others in the decertification effort by providing legal assistance."
     
  • And then there was forgery and fraud: Workers whose names appeared on the petition and were interviewed by state investigators said they refused to sign the petition, weren't asked to sign it or never signed it. Other findings from the ALRB included the following: "The submission of a large number of forged signatures...including seven pages of forged signatures submitted [to the ALRB]...The names on each page were printed in the exact same handwriting...all 88 names on these pages were written down in alphabetical order." In total, ALRB found "compelling evidence of the submission of 100 falsified signatures" and concluded that "the forgeries may have been more widespread" than the agency's brief investigation uncovered. "The existence of so many forged signatures identified across different crews, [farm labor] contractors and time periods" mean the petition does not have enough valid signatures to trigger a decertification election, the ALRB concluded.

After the state of California recently issued a formal complaint (amounting to an indictment) against Gerawan for actively supporting the decertification, after a Fresno County Superior Court judge issued an order for the giant company to "cease and desist" from breaking the law and after the ALRB threw out the decertification petition, Gerawan is still fighting its workers' desire to enjoy union protections. Gerawan's big spending on PR and legal campaigns against its own workers is forcing the UFW to wage legal battles to defend the them.

We are already making a difference. The UFW and the 25-member union negotiating committee selected by Gerawan's workers negotiated wage increases for all Gerawan workers of between $1 to $2.50 an hour that have already been implemented. General labor workers' pay went from  $9 to $10 an hour. Workers are still fighting to win other benefits and protections they deserve through a union contract.

Did you hear? Big news on immigration today!

Latino and Democratic leaders have broken the stalemate in the House and introduced an immigration bill with a roadmap to citizenship for 11 million aspiring Americans!

We have a long, tough fight ahead and the bill is far from perfect -- but if it passes, it would:
• Provide a path to citizenship for a vast majority of the 11 million
• Removes the "border surge" found in the Senate bill
• Reunite many families separated by deportation
• Protect immigrant workers
• Force DHS to focus on results rather than just continuing to expand immigration enforcement indefinitely.
• Allow nearly 11 million immigrants to work, travel and live without fear of deportation (including some with final removal orders)
• Grant a 5 year path to citizenship for Dreamers and farm workers
• Provides immigration status and affordable housing to victims of domestic abuse
• Prohibit ICE from conducting raids/arrests outside schools, churches, hospitals and other “sensitive locations”

For us, this fight is personal. The cost of inaction on immigration affects our friends, family, and community. Since the Senate passed their immigration bill, over 100,000 aspiring Americans have been deported, and that number grows every single day.

We will not stop until we achieve a permanent solution that grants dignity and respect to all immigrant workers and families, and that means a chance for 11 million aspiring Americans to earn citizenship in the country they call home.

University of Utah to host public forum on immigration reform



The University of Utah's John R. Park Debate Society will host a public forum addressing citizenship and immigration reform, Oct. 2, 7 p.m., in the College of Social Work auditorium.

SALT LAKE CITY — The University of Utah’s John R. Park Debate Society will host a public forum addressing citizenship and immigration reform on Oct. 2, 7 p.m., in the College of Social Work auditorium.
Titled “Life Divided: The National Debate Over Immigration Reform,” the event will include guests who have been active participants in statewide and national debates about the issue. The event is free and open to the public.
Co-sponsored by the university’s My Utah Signature Experience project, the forum includes Tony Yapias of Proyecto Latino de Utah, Robert Wren of Utahns for Immigration Reform and Enforcement, Jean Hill of Salt Lake Catholic Diocese, and Arturo Morales-Llan of Legal Immigrants for Immigration Law Enforcement.
The debate will focus on Rep. Chris Stewart’s proposal for legal status for undocumented immigrants, which would allow them to live in the United States without imprisonment or deportation after appropriate penalties. However, the proposal would not allow these same individuals a special pathway to citizenship.
In addition, the debate society will conduct a demonstration debate on the topic titled “Resolved: The United States Federal Government Should Pass Rep. Chris Stewart’s Legal Status Proposal for Undocumented Immigrants Living in the US.”
The John R. Park Debate Society at the U. is an intercollegiate competitive debate team.
